Article 568 bis of the French General Tax Code

As an exception to Article 568, in the overseas departments, from 1 January 2019 only persons who are qualified traders and hold a licence granted on behalf of the department by the president of the departmental council may sell tobacco at retail. A licence is only valid for one sales outlet.

The number of licences granted per department is determined in application of general location rules laid down by decree. These rules take particular account of the number of inhabitants per commune.

This licence may not be granted for the retail sale of tobacco in a retail shop with a sales area of more than 200 square metres or in shopping arcades adjoining supermarkets or hypermarkets, excluding areas reserved for the distribution of fuel, or in a wholesale shop open to private individuals. This prohibition does not apply to tobacco retail shops set up on 1 January 2018 in shopping arcades adjoining supermarkets or hypermarkets.

The issue of this licence is subject to the payment, to the benefit of the overseas department concerned, of an annual fee, the amount of which is set by deliberation of the departmental council.

From 1 January 2019, only licensed distributors may sell manufactured tobacco to the persons mentioned in the first paragraph.

As a transitional measure, retailers who habitually sold manufactured tobacco prior to 1 January 2019 and who have not been granted a licence in respect of 2019 are authorised to continue selling to private individuals for the period strictly necessary for them to use up their stock and until 30 June 2019 at the latest.

Article 568 bis

Par dérogation à l’article 568, dans les départements d’outre-mer, seuls peuvent vendre du tabac au détail, à compter du 1er janvier 2019, les personnes ayant la qualité de commerçants, titulaires d’une licence accordée au nom du département par le président du conseil départemental. Une licence ne vaut que pour un point de vente.

Le nombre de licences accordées par département est déterminé en application de règles générales d’implantation fixées par décret. Ces règles tiennent notamment compte du nombre d’habitants par commune.

Cette licence ne peut être accordée pour la vente au détail du tabac dans un magasin de commerce de détail d’une surface de vente supérieure à 200 mètres carrés ou dans les galeries marchandes attenantes à des supermarchés ou des hypermarchés, à l’exclusion des surfaces réservées à la distribution de carburants, ou dans un magasin de vente en gros ouvert aux particuliers. Ne sont pas concernés par cette interdiction les magasins de commerce de détail du tabac installés au 1er janvier 2018 dans les galeries marchandes attenantes à des supermarchés ou des hypermarchés.

La délivrance de cette licence est soumise au versement, au profit du département d’outre-mer concerné, d’une redevance annuelle dont le montant est fixé par délibération du conseil départemental.

A compter du 1er janvier 2019, seuls les distributeurs agréés peuvent vendre du tabac manufacturé aux personnes mentionnées au premier alinéa.

A titre transitoire, les détaillants vendant habituellement du tabac manufacturé antérieurement au 1er janvier 2019 et n’ayant pas bénéficié de l’attribution d’une licence au titre de l’année 2019 sont autorisés à poursuivre la vente aux particuliers pendant la période strictement nécessaire à l’épuisement de leur stock et au plus tard jusqu’au 30 juin 2019.
