The Court of Revision and Reconsideration appoints from among its members, for a period of three years, renewable once, five permanent magistrates and five substitute magistrates who make up the committee investigating applications for revision and reconsideration. The committee appoints a chairman from among its members. The judges who sit on the investigating committee and their alternates may not sit on the judgment panel of the Court of Revision and Reconsideration.
The thirteen other judges make up the judgement panel of the Court of Revision and Reconsideration, which rules on the revision or reconsideration. The judgment panel is presided over by the president of the criminal chamber.
The public prosecutor’s office at the Cour de cassation acts as the public prosecutor before the investigating committee and the trial panel.
Magistrates who, in the case submitted to the Court of Revision and Reconsideration, have, within other jurisdictions, either carried out an act of prosecution or investigation, or participated in a decision on the merits relating to the applicant’s guilt, may not sit on the investigating committee and the trial panel or perform the functions of the public prosecutor therein.
