In the event of the commission of a flagrant offence punishable by a prison sentence other than those provided for in this Code, customs officers may arrest the alleged offender with a view to handing him over to a judicial police officer or, in the case of offences for which he is competent, to a customs officer authorised pursuant toArticle 28-1 of the Code of Criminal Procedure, on the instructions of the public prosecutor in whose jurisdiction the offence is recorded, after the latter has been informed by any means.
Customs officers may physically apprehend the evidence gathered during the inspection, on condition that they make an immediate inventory of it, refrain from any investigative act concerning it, pass it on to the judicial police officer or customs officer mentioned in the first paragraph of this article so that he can seize it and place it under seal and ensure, in the meantime, that its integrity cannot be compromised in any way.
Customs officers may immobilise the means of transport and the goods, and hold the person arrested against his or her will for the time strictly necessary to record the control operations in the official report and hand them over to the judicial police officer or customs officer mentioned in the same first paragraph, under the supervision of the public prosecutor.
