I. When the average income of a farmer, for all of his farms, exceeds €91,900, excluding tax, over three consecutive years, the person concerned is compulsorily taxed according to a real system of taxation from the taxation of income for the first year following the three-year period in question.
II. A simplified tax regime applies to small and medium-sized farmers subject to income tax:
a. By option, to farmers normally placed under the scheme provided for in article 64 bis;
b. As of right, to other operators whose average revenue, measured over three consecutive years, does not exceed €391,000, excluding tax.
III. If the limit mentioned in b of II is exceeded, the interested parties are automatically subject to the normal actual taxation system from the first financial year following the three-year period in question.
The two categories of operators provided for in II as well as those subject to the simplified taxation regime pursuant to Article 69 C may opt for the normal actual taxation regime.
IV. The options mentioned in a of II and in the second paragraph of III must be made within the deadline for filing the income tax return for the year or financial year preceding that in respect of which they apply.
For farmers who wish to opt for an actual tax regime from their first financial year of activity, the option must be exercised within the deadlines applicable to the filing of the return submitted in respect of their first period of activity.
V. The revenue to be taken into account when assessing the limits provided for in b of II corresponds to the acquired receivables determined under the conditions provided for in 2 bis of Article 38.
VI.-.The thresholds mentioned in I and II are updated every three years in the same proportion as the three-yearly change in the upper limit of the first bracket of the income tax scale and are rounded, respectively, to the nearest hundred euros and the nearest thousand euros.
For the application of the provisions of this article and of II and IV of Article 151 septies, revenue from breeding or farming operations involving animals or products belonging to third parties is multiplied by three.
