If the execution of a request for mutual assistance from a foreign judicial authority is likely to undermine public order or the essential interests of the Nation, the Public Prosecutor to whom the request has been referred or who has been notified of the request pursuant to the third paragraph of Article 694-1 shall forward it to the Public Prosecutor who shall determine whether to refer the matter to the Minister of Justice and shall, where appropriate, give notice of such referral to the investigating judge.
If the matter is referred to him, the Minister of Justice informs the requesting authority, where appropriate, that his request cannot be acted upon, in whole or in part. This information shall be notified to the judicial authority concerned and shall preclude the execution of the request for mutual assistance or the return of the executing documents.
