Article 696-52 of the French Code of Criminal Procedure

A decision to place a person under judicial supervision may give rise to transmission to the competent authority of another Member State of the European Union where:

1° The person concerned is habitually resident, under lawful conditions, in the territory of the executing State and, having been informed of the measures concerned, consents to return there;

2° The person concerned requests that the decision to place him or her under judicial supervision be executed in a Member State other than that in which he or she is habitually resident, under lawful conditions, and the competent authority of that State consents to the transmission of the decision to place him or her under judicial supervision.

Article 696-52

Une décision de placement sous contrôle judiciaire peut donner lieu à une transmission à l’autorité compétente d’un autre Etat membre de l’Union européenne lorsque :

1° La personne concernée réside de manière habituelle, dans des conditions régulières, sur le territoire de l’Etat d’exécution et, ayant été informée des mesures concernées, consent à y retourner ;

2° La personne concernée demande que la décision de placement sous contrôle judiciaire s’exécute dans un autre Etat membre que celui dans lequel elle réside de manière habituelle, dans des conditions régulières, et l’autorité compétente de cet Etat consent à la transmission de la décision de placement sous contrôle judiciaire la concernant.
