Article 696-91 of the French Code of Criminal Procedure

A European protection order may be issued by the public prosecutor at the request of the victim or the victim’s legal representative. The victim shall be informed of this right when one of the prohibitions mentioned in Article 696-90 is issued in his or her favour.

The competent public prosecutor is the one attached to the judicial court within whose jurisdiction is located the competent authority that ordered the prohibition on the basis of which a European protection order may be issued.

If the public prosecutor to whom the request has been addressed does not have jurisdiction, he shall forward it without delay to the competent public prosecutor and shall notify the victim accordingly.

Une décision de protection européenne peut être émise par le procureur de la République, sur demande de la victime ou de son représentant légal. La victime est informée de ce droit lorsqu’est prise à son bénéfice une des interdictions mentionnées à l’article 696-90.

Le procureur de la République compétent est celui près le tribunal judiciaire dans le ressort duquel se trouve l’autorité compétente qui a ordonné l’interdiction sur le fondement de laquelle peut être émise une décision de protection européenne.

Si le procureur de la République auquel la demande a été adressée n’est pas compétent, il la transmet sans délai au procureur de la République compétent et en avise la victime.
