Article 696-97 of the French Code of Criminal Procedure

The public prosecutor receives requests for the recognition and enforcement on the territory of the Republic of European protection decisions issued by the competent authorities of other Member States.

The competent public prosecutor is the one in whose jurisdiction the victim intends to stay or reside. Failing this, the public prosecutor at the Paris judicial court has jurisdiction.

If the public prosecutor to whom the European protection order has been forwarded by the issuing Member State is not competent to act on it, he or she shall forward it without delay to the competent public prosecutor and inform the competent authority of the issuing State accordingly.

Le procureur de la République reçoit les demandes tendant à la reconnaissance et à l’exécution sur le territoire de la République des décisions de protection européennes émises par les autorités compétentes des autres Etats membres.

Le procureur de la République compétent est celui dans le ressort duquel la victime projette de séjourner ou de résider. A défaut, le procureur de la République près le tribunal judiciaire de Paris est compétent.

Si le procureur de la République auquel la décision de protection européenne a été transmise par l’Etat membre d’émission n’est pas compétent pour y donner suite, il la transmet sans délai au procureur de la République compétent et en informe l’autorité compétente de l’Etat d’émission.
