Article 705-3 of the French Code of Criminal Procedure

The order made pursuant to article 705-2 may, to the exclusion of all other means of appeal, be referred within five days of its notification, at the request of the Public Prosecutor or the parties, to the Criminal Division of the Court of Cassation. Within eight days of receiving the file, the Criminal Division appoints the investigating judge responsible for continuing the investigation. The Public Prosecutor may also refer the matter directly to the Criminal Division of the Court of Cassation if the investigating judge has not made an order within the one-month period provided for in the first paragraph of article 705-2.

The investigating judge and the Public Prosecutor are informed of the Criminal Division’s ruling and the parties are notified of it.
