In the event of an investigation being opened for one of the offences falling within the scope of articles 706-73,706-73-1and 706-74 and in order to guarantee payment of the fines incurred and, where applicable, compensation for victims, the liberty and custody judge, at the request of the public prosecutor, may order, at the advanced expense of the Treasury and in accordance with the procedures laid down by civil enforcement procedures, protective measures on the movable or immovable, divided or undivided property of the person under investigation.
The conviction constitutes validation of the precautionary measures and allows the definitive registration of the securities.
A decision to dismiss, discharge or acquit automatically entails, at the Treasury’s expense, the release of the measures ordered. The same applies if the public prosecution and the civil action are terminated.
For the application of the provisions of this article, the juge des libertés et de la détention shall have jurisdiction throughout the national territory.
This Article shall apply without prejudice to the provisions of Title XXIX of this Book.
