Article 706-112-3 of the French Code of Criminal Procedure

When the information gathered in the course of a preliminary investigation reveals that a person whose home is to be searched is subject to a legal protection measure revealing that he or she is not in a position to exercise alone his or her right to oppose the carrying out of this operation, the officer shall notify by any means his or her curator or guardian, so that the person’s possible assent provided for in the first two paragraphs of Article 76 is given only after he or she has been able to speak with the curator or guardian. Failing this, the search must be authorised by the juge des libertés et de la détention pursuant to the penultimate paragraph of the same article 76.

Lorsque les éléments recueillis au cours d’une enquête préliminaire font apparaître qu’une personne chez laquelle il doit être procédé à une perquisition fait l’objet d’une mesure de protection juridique révélant qu’elle n’est pas en mesure d’exercer seule son droit de s’opposer à la réalisation de cette opération, l’officier en avise par tout moyen son curateur ou son tuteur, afin que l’assentiment éventuel de la personne prévu aux deux premiers alinéas de l’article 76 ne soit donné qu’après qu’elle a pu s’entretenir avec lui. A défaut, la perquisition doit être autorisée par le juge des libertés et de la détention en application de l’avant-dernier alinéa du même article 76.
