Article 706-129 of the French Code of Criminal Procedure

Where, pursuant to articles 349-1 and 361-1, the Assize Court has, in the course of its deliberations, answered in the affirmative the first question relating to the commission of the acts and in the affirmative the second question relating to the application of the first paragraph of article 122-1 of the Penal Code, it declared the accused not criminally responsible on the grounds of mental disorder.

Lorsqu’en application des articles 349-1 et 361-1, la cour d’assises a, au cours du délibéré, répondu positivement à la première question relative à la commission des faits et positivement à la seconde question portant sur l’application du premier alinéa de l’article 122-1 du code pénal, elle déclare l’irresponsabilité pénale de l’accusé pour cause de trouble mental.
