Article 706-15-1 of the French Code of Criminal Procedure

Any natural person who, having brought a civil action, has benefited from a final decision awarding damages and interest as compensation for the harm they have suffered as a result of a criminal offence, but who cannot obtain compensation under the articles 706-3 or 706-14, may apply for assistance in recovering these damages and interest as well as the sums awarded pursuant to articles 375 ou 475-1.

This assistance may be requested even if the offender is subject to an obligation to compensate the victim as part of a sanction-reparation sentence, a probationary suspension or a decision to adjust the sentence or release on parole.

Toute personne physique qui, s’étant constituée partie civile, a bénéficié d’une décision définitive lui accordant des dommages et intérêts en réparation du préjudice qu’elle a subi du fait d’une infraction pénale, mais qui ne peut pas obtenir une indemnisation en application des articles 706-3 ou 706-14, peut solliciter une aide au recouvrement de ces dommages et intérêts ainsi que des sommes allouées en application des articles 375 ou 475-1.


Cette aide peut être sollicitée y compris si l’auteur de l’infraction fait l’objet d’une obligation d’indemnisation de la victime dans le cadre d’une peine de sanction-réparation, d’un sursis probatoire ou d’une décision d’aménagement de peine ou de libération conditionnelle.
