Officers and agents of the judicial police, assigned to the judicial police services specially responsible for combating terrorism, may be authorised by name by the public prosecutor at the Paris court of appeal to carry out investigations relating to offences falling within the scope of Article 706-16, identifying themselves by their administrative registration number. They may be authorised to give evidence or appear as witnesses under the same number.
The civil status of the judicial police officers and agents referred to in the first paragraph may only be disclosed by decision of the Public Prosecutor at the Paris Court of Appeal. It shall also be communicated, at his request, to the president of the court hearing the case.
The provisions of Article 706-84 are applicable in the event of disclosure of the identity of these officers or agents of the judicial police, except in the cases provided for in the previous paragraph.
No conviction may be handed down solely on the basis of procedural acts carried out by investigators who have benefited from the provisions of this article and whose civil status has not been communicated, at their request, to the president of the court hearing the case.
The detailed rules for the application of this article shall, where necessary, be specified by decree in the Conseil d’Etat.
