Article 706-25-6 of the French Code of Criminal Procedure

Without prejudice to the application of articles 706-25-11 and 706-25-12, the information mentioned in Article 706-25-4 concerning the same person shall be removed from the file on the death of the person concerned or on expiry, as from the pronouncement of the decision provided for in the same Article 706-25-4, of a period of :

1° Twenty years in the case of an adult;

2° Ten years in the case of a minor.

When they concern an offence mentioned in Articles 421-2-5 and 421-2-5-1 of the Criminal Code and Articles L. 224-1or L. 225-7 of the Internal Security Code, the information referred to in Article 706-25-4 of this Code concerning the same person shall be removed from the file on the death of the person concerned or on expiry of a period of:

a) Five years in the case of an adult;

b) Three years in the case of a minor.

Where the person is serving an unsuspended custodial sentence pursuant to the conviction leading to registration, these time limits do not begin to run until their release.

Amnesty or pardon, as well as the rules specific to the erasure of convictions appearing in the criminal record, do not result in the erasure of this information.

This information cannot, on its own, be used as evidence to establish the state of recidivism.

The entries provided for in 1°, 2° and 5° of Article 706-25-4 shall be removed from the file in the event of a final decision to dismiss, acquit or acquit.

The entries provided for in the same 5° may also be removed by a specially reasoned decision of the court.

Sans préjudice de l’application des articles 706-25-11 et 706-25-12, les informations mentionnées à l’article 706-25-4 concernant une même personne sont retirées du fichier au décès de l’intéressé ou à l’expiration, à compter du prononcé de la décision prévue au même article 706-25-4, d’un délai de :

1° Vingt ans s’il s’agit d’un majeur ;

2° Dix ans s’il s’agit d’un mineur.

Lorsqu’elles concernent une infraction mentionnée aux articles 421-2-5 et 421-2-5-1 du code pénal et aux articles L. 224-1 ou L. 225-7 du code de la sécurité intérieure, les informations mentionnées à l’article 706-25-4 du présent code concernant une même personne sont retirées du fichier au décès de l’intéressé ou à l’expiration, à compter du prononcé de la décision, d’un délai de :

a) Cinq ans s’il s’agit d’un majeur ;

b) Trois ans s’il s’agit d’un mineur.

Lorsque la personne exécute une peine privative de liberté sans sursis en application de la condamnation entraînant l’inscription, ces délais ne commencent à courir qu’à compter de sa libération.

L’amnistie ou la réhabilitation ainsi que les règles propres à l’effacement des condamnations figurant au casier judiciaire n’entraînent pas l’effacement de ces informations.

Ces informations ne peuvent, à elles seules, servir de preuve à la constatation de l’état de récidive.

Les mentions prévues aux 1°, 2° et 5° de l’article 706-25-4 sont retirées du fichier en cas de décision définitive de non-lieu, de relaxe ou d’acquittement.

Les mentions prévues au même 5° peuvent également être retirées sur décision spécialement motivée de la juridiction.
