Where it appears to the examining magistrate of the Paris Judicial Court that the acts referred to him do not constitute one of the offences falling within the scope of Article 706-72 and do not fall within its jurisdiction on any other grounds, this judge shall declare that he has no jurisdiction either at the request of the Public Prosecutor or, after receiving the latter’s opinion, of his own motion or at the request of the parties. The parties who have not submitted an application are notified in advance and invited to make their observations known; the order is made at the earliest eight days after this notification.
The second paragraph of Article 706-72-2 shall apply to the order by which the investigating judge of the Paris judicial court declares that he has no jurisdiction.
As soon as the order has become final, the Paris public prosecutor shall send the case file to the public prosecutor with territorial jurisdiction.
This article applies when the Investigating Chamber of the Paris Court of Appeal rules on its jurisdiction.
