Article 706-72-3 of the French Code of Criminal Procedure

Where it appears to the examining magistrate of the Paris Judicial Court that the acts referred to him do not constitute one of the offences falling within the scope of Article 706-72 and do not fall within its jurisdiction on any other grounds, this judge shall declare that he has no jurisdiction either at the request of the Public Prosecutor or, after receiving the latter’s opinion, of his own motion or at the request of the parties. The parties who have not submitted an application are notified in advance and invited to make their observations known; the order is made at the earliest eight days after this notification.

The second paragraph of Article 706-72-2 shall apply to the order by which the investigating judge of the Paris judicial court declares that he has no jurisdiction.

As soon as the order has become final, the Paris public prosecutor shall send the case file to the public prosecutor with territorial jurisdiction.

This article applies when the Investigating Chamber of the Paris Court of Appeal rules on its jurisdiction.

Lorsqu’il apparaît au juge d’instruction du tribunal judiciaire de Paris que les faits dont il a été saisi ne constituent pas une des infractions entrant dans le champ d’application de l’article 706-72 et ne relèvent pas de sa compétence à un autre titre, ce juge se déclare incompétent soit à la requête du procureur de la République, soit, après avis de ce dernier, d’office ou à la requête des parties. Celles des parties qui n’ont pas présenté une requête sont préalablement avisées et invitées à faire connaître leurs observations ; l’ordonnance est rendue au plus tôt huit jours après cet avis.


Le deuxième alinéa de l’article 706-72-2 est applicable à l’ordonnance par laquelle le juge d’instruction du tribunal judiciaire de Paris se déclare incompétent.


Dès que l’ordonnance est devenue définitive, le procureur de la République de Paris adresse le dossier de la procédure au procureur de la République territorialement compétent.


Le présent article est applicable lorsque la chambre de l’instruction de la cour d’appel de Paris statue sur sa compétence.
