One or more enforcement courts are established within the jurisdiction of each court of appeal, the territorial jurisdiction of which, corresponding to that of one or more judicial courts within the jurisdiction, is set by decree. The sentence enforcement court is composed of a president and two assessors appointed by the first president from among the sentence enforcement judges within the court’s jurisdiction.
In the overseas departments, at least one member of the sentence enforcement court is a sentence enforcement judge. A sentence enforcement court is also set up at the Cayenne judicial court and is made up of at least one sentence enforcement judge. In New Caledonia, French Polynesia and the collectivity of Saint-Pierre-et-Miquelon, the sentence enforcement court may be composed of a single member, a sentence enforcement judge.
The adversarial hearings held by this court take place at the seat of the various judicial courts within the jurisdiction of the court of appeal or in the prisons within that jurisdiction.
The functions of the public prosecutor shall be performed by the public prosecutor of the judicial court where the adversarial hearing is held or within whose jurisdiction the prison where the hearing is held is situated.
