Article 713-13 of the French Code of Criminal Procedure

The confiscation order and certificate shall be sent in accordance with the procedures set out in Article 713-4 or sent to the public prosecutor at the criminal court with territorial jurisdiction, either directly or via the public prosecutor.

The criminal court with territorial jurisdiction is that of the place where any of the confiscated assets are located or, failing that, the Paris criminal court.

If the public prosecutor to whom the request has been addressed does not have territorial jurisdiction to act on it, he or she shall forward it without delay to the public prosecutor at the criminal court with territorial jurisdiction and shall inform the competent authority of the issuing State.

La décision de confiscation et le certificat sont transmis selon les modalités prévues à l’article 713-4 ou adressés au procureur de la République près le tribunal correctionnel territorialement compétent, directement ou par l’intermédiaire du procureur général.


Le tribunal correctionnel territorialement compétent est celui du lieu où se situe l’un quelconque des biens confisqués ou, à défaut, le tribunal correctionnel de Paris.


Si le procureur de la République auquel la demande a été adressée n’est pas territorialement compétent pour y donner suite, il la transmet sans délai au procureur de la République près le tribunal correctionnel territorialement compétent et en informe l’autorité compétente de l’Etat d’émission.
