Article 713-37 of the French Code of Criminal Procedure

Without prejudice to the application of Article 694-4, execution of the confiscation shall be refused:

1° If the facts giving rise to the request do not constitute an offence under French law;

2° If the property to which it relates is not liable to confiscation under French law;

3° If the foreign decision was handed down under conditions that do not offer sufficient guarantees with regard to the protection of individual freedoms and the rights of the defence;

4° If it is established that the foreign decision was issued for the purpose of prosecuting or convicting a person on the grounds of their sex, race, religion, ethnic origin, nationality, language, political opinions or sexual orientation or gender identity…;

5° If the French Public Prosecutor’s Office had decided not to prosecute the acts for which the confiscation was ordered by the foreign court or if these acts have already been finally judged by the French judicial authorities or by those of a State other than the requesting State, provided, in the event of conviction, that the sentence has been served, is in the process of being served or can no longer be brought to execution under the laws of the sentencing State;

6° If it relates to a political offence.

Sans préjudice de l’application de l’article 694-4, l’exécution de la confiscation est refusée :

1° Si les faits à l’origine de la demande ne sont pas constitutifs d’une infraction selon la loi française ;

2° Si les biens sur lesquels elle porte ne sont pas susceptibles de faire l’objet d’une confiscation selon la loi française ;

3° Si la décision étrangère a été prononcée dans des conditions n’offrant pas de garanties suffisantes au regard de la protection des libertés individuelles et des droits de la défense ;

4° S’il est établi que la décision étrangère a été émise dans le but de poursuivre ou de condamner une personne en raison de son sexe, de sa race, de sa religion, de son origine ethnique, de sa nationalité, de sa langue, de ses opinions politiques ou de son orientation sexuelle ou identité de genre ;

5° Si le ministère public français avait décidé de ne pas engager de poursuites pour les faits à raison desquels la confiscation a été prononcée par la juridiction étrangère ou si ces faits ont déjà été jugés définitivement par les autorités judiciaires françaises ou par celles d’un Etat autre que l’Etat demandeur, à condition, en cas de condamnation, que la peine ait été exécutée, soit en cours d’exécution ou ne puisse plus être ramenée à exécution selon les lois de l’Etat de condamnation ;

6° Si elle porte sur une infraction politique.
