Article 729-3 of the French Code of Criminal Procedure

Conditional release may be granted to any person sentenced to a custodial sentence of less than or equal to four years, or for which the remaining sentence is less than or equal to four years, where that person exercises parental authority over a child under the age of ten who is ordinarily resident with that parent, or where the child is more than twelve weeks pregnant.

The provisions of this article do not apply to persons sentenced for a felony or misdemeanour committed against a minor.

La libération conditionnelle peut être accordée pour tout condamné à une peine privative de liberté inférieure ou égale à quatre ans, ou pour laquelle la durée de la peine restant à subir est inférieure ou égale à quatre ans, lorsque ce condamné exerce l’autorité parentale sur un enfant de moins de dix ans ayant chez ce parent sa résidence habituelle ou lorsqu’il s’agit d’une femme enceinte de plus de douze semaines.

Les dispositions du présent article ne sont pas applicables aux personnes condamnées pour un crime ou pour un délit commis sur un mineur.
