Article 739 of the French Code of Criminal Procedure

When a conviction is accompanied by a probationary suspension, the sentenced person is placed under the supervision of the territorially competent sentence enforcement judge in accordance with the procedures set out in Article 712-10.

During the probation period, the sentenced person must comply with all the supervision measures provided for by article 132-44 of the Penal Code and those of the specific obligations provided for by article 132-45 of the same code that are specially imposed on him, either by the sentencing decision or by a decision that may, at any time, including during a period of incarceration of the sentenced person, be taken by the sentence enforcement judge pursuant to the provisions of l’article 712-8.

Lorsqu’une condamnation est assortie du sursis probatoire, le condamné est placé sous le contrôle du juge de l’application des peines territorialement compétent selon les modalités prévues par l’article 712-10.

Au cours du délai de probation, le condamné doit satisfaire à l’ensemble des mesures de contrôle prévues par l’article 132-44 du code pénal et à celles des obligations particulières prévues par l’article 132-45 du même code qui lui sont spécialement imposées, soit par la décision de condamnation, soit par une décision que peut, à tout moment, y compris pendant une période d’incarcération du condamné, prendre le juge de l’application des peines en application des dispositions de l’article 712-8.
