Article 747-1-1 of the French Code of Criminal Procedure

In the event of a change in the sentenced person’s situation since the sentencing decision that does not allow the sentence imposed to be enforced, the sentence enforcement judge may ex officio, at the request of the person concerned or at the request of the public prosecutor order by reasoned decision, taken in accordance with the provisions of Article 712-6 :

1° To convert a sentence of community service or a probationary suspended sentence including the obligation to perform community service into a sentence of days’ fine or a sentence of home detention under electronic surveillance;

2° To convert a sentence of home detention under electronic surveillance into a sentence of community service or a sentence of days’ fine;

3° To convert a sentence of days’ fine into a sentence of community service or a sentence of home detention under electronic surveillance.

Conversion to a community service sentence is only possible if, after being informed of the right to refuse to perform community service, the convicted person has expressly stated that he or she waives this right. In the case provided for in 3°, the duration of home detention under electronic surveillance may not exceed that which would have resulted from failure to carry out the day fine sentence, set in application of the first sentence of the second paragraph of article 131-25 of the French Penal Code. By way of derogation from the same second paragraph, the conversion decision may also be made in the event of total or partial failure to pay the amount due on expiry of the period corresponding to the number of day fines imposed.

En cas de modification de la situation du condamné depuis la décision de condamnation qui ne permet pas la mise à exécution de la peine prononcée, le juge de l’application des peines peut d’office, à la demande de l’intéressé ou sur réquisitions du procureur de la République ordonner par décision motivée, prise conformément aux dispositions de l’article 712-6 :

1° De convertir la peine de travail d’intérêt général ou la peine de sursis probatoire comportant l’obligation d’accomplir un travail d’intérêt général en une peine de jours-amende ou une peine de détention à domicile sous surveillance électronique ;

2° De convertir une peine de détention à domicile sous surveillance électronique en une peine de travail d’intérêt général ou une peine de jours-amende ;

3° De convertir une peine de jours-amende en une peine de travail d’intérêt général ou une peine de détention à domicile sous surveillance électronique.

La conversion en peine de travail d’intérêt général n’est possible que si, après avoir été informé du droit de refuser l’accomplissement d’un travail d’intérêt général, le condamné a expressément déclaré renoncer à se prévaloir de ce droit. Dans le cas prévu au 3°, la durée de la détention à domicile sous surveillance électronique ne peut excéder celle qui serait résultée de l’inexécution de la peine de jours-amende, fixée en application de la première phrase du second alinéa de l’article 131-25 du code pénal. Par dérogation au même second alinéa, la décision de conversion peut également intervenir en cas de défaut total ou partiel du paiement du montant exigible à l’expiration du délai correspondant au nombre de jours-amende prononcé.
