Article 748 of the French Code of Criminal Procedure

When, after an escape followed by a recapture or in any other circumstances, the identity of a convicted person is challenged, the challenge shall be decided in accordance with the rules established for incidents of enforcement. However, the hearing shall be public.

If the challenge arises in the course of and on the occasion of a new prosecution, it shall be decided by the court or tribunal hearing that prosecution.

Lorsque, après une évasion suivie de reprise ou dans toute autre circonstance, l’identité d’un condamné fait l’objet d’une contestation, cette contestation est tranchée suivant les règles établies en matière d’incidents d’exécution. Toutefois l’audience est publique.

Si la contestation s’élève au cours et à l’occasion d’une nouvelle poursuite, elle est tranchée par la cour ou le tribunal saisi de cette poursuite.
