Article 75-2 of the French Code of Criminal Procedure

The judicial police officer conducting a preliminary investigation into a crime or misdemeanour notifies the public prosecutor as soon as a person against whom there is evidence giving rise to a presumption that he has committed or attempted to commit the offence is identified.
