Before transmitting the sentencing decision or the probation decision and the certificate, the public prosecutor may consult the competent authority of the executing State. Such consultation is mandatory in the cases mentioned in 2° of Article 764-5, in order to determine whether that authority consents to the transmission.
Avant de procéder à la transmission de la décision de condamnation ou de la décision de probation et du certificat, le ministère public peut consulter l’autorité compétente de l’Etat d’exécution. Une telle consultation est obligatoire dans les cas mentionnés au 2° de l’article 764-5, afin de déterminer si cette autorité consent à la transmission.
