Article 764-12 of the French Code of Criminal Procedure

The public prosecutor may decide to withdraw the certificate, provided that monitoring has not begun in the executing State, in the following cases:

1° Where it considers that the maximum period of deprivation of liberty provided for under the domestic law of the executing State that may be imposed in the event of non-compliance with alternative sanctions or probation measures is insufficient;

2° Where recognition of the sentence or probation decision entails an adaptation of the sanctions or measures or a reduction in their duration that it considers inappropriate.

Where it decides to withdraw the certificate, the public prosecutor shall inform the competent authority of the executing State as soon as possible, and at the latest within ten days of receiving the information justifying its decision.

In this case, the French judicial authorities remain competent to enforce the sentence or the probation decision and to monitor their enforcement.

Article 764-12

Le ministère public peut décider de retirer le certificat, pour autant que le suivi n’ait pas commencé dans l’Etat d’exécution, dans les cas suivants :

1° Lorsqu’il estime que la durée maximale de la privation de liberté prévue par le droit interne de l’Etat d’exécution susceptible d’être prononcée en cas de non-respect des peines de substitution ou des mesures de probation est insuffisante ;

2° Lorsque la reconnaissance de la condamnation ou de la décision de probation implique une adaptation des peines ou des mesures ou une réduction de la durée de celles-ci qui lui semblent inappropriées.

Lorsqu’il décide de retirer le certificat, le ministère public en informe l’autorité compétente de l’Etat d’exécution le plus rapidement possible, au plus tard dans les dix jours suivant la réception des informations justifiant sa décision.

En ce cas, les autorités judiciaires françaises restent compétentes pour mettre à exécution la condamnation ou la décision de probation et assurer le suivi de leur exécution.
