Article 764-19 of the French Code of Criminal Procedure

The competent public prosecutor is the one in whose jurisdiction the convicted person’s lawful habitual residence is located. Failing this, the public prosecutor at the Paris judicial court has jurisdiction.

If the public prosecutor to whom the request has been addressed by the sentencing State for the purposes of recognition and enforcement does not have jurisdiction, he will forward it without delay to the competent public prosecutor. The competent authority of the issuing State shall be informed of the forwarding.

Le procureur de la République compétent est celui dans le ressort duquel se situe la résidence habituelle régulière de la personne condamnée. A défaut, le procureur de la République près le tribunal judiciaire de Paris est compétent.

Si le procureur de la République auquel la demande a été adressée par l’Etat de condamnation aux fins de reconnaissance et d’exécution n’est pas compétent, il la transmet sans délai au procureur de la République compétent. L’autorité compétente de l’Etat d’émission est informée de la transmission.
