Article 764-20 of the French Code of Criminal Procedure

Where, before transmitting the conviction or probation decision and the certificate, the competent authority of the sentencing State consults the Public Prosecutor in cases where, pursuant to 2° of article 764-5, recognition of the conviction or decision is subject to the consent of the executing State, the Public Prosecutor consents to the transmission of the conviction or probation decision if the person concerned is of French nationality. In all other cases, he shall immediately refer the matter to the Minister of Justice. The Minister may consent to the transfer of the sentence or decision if the person concerned has the nationality of a Member State of the European Union other than France and if there are exceptional grounds justifying the enforcement of the decision in France. In particular, it takes into account the interest of its decision for the proper administration of justice, the existence of personal and family ties in France and the absence of any risk of disturbing public order.

The public prosecutor will inform the competent authority in the convicting State of the decision whether or not to consent to the transmission of the application for recognition of the conviction or the probation decision.

Lorsque, avant de transmettre la condamnation ou la décision de probation et le certificat, l’autorité compétente de l’Etat de condamnation consulte le procureur de la République dans le cas où, en application du 2° de l’article 764-5, la reconnaissance de la condamnation ou de la décision est subordonnée au consentement de l’Etat d’exécution, le procureur de la République consent à la transmission de la condamnation ou de la décision de probation si la personne concernée a la nationalité française. Dans les autres cas, il saisit sans délai le ministre de la justice. Le ministre peut consentir à la transmission de la condamnation ou de la décision si la personne concernée a la nationalité d’un Etat membre de l’Union européenne autre que la France et s’il existe des motifs exceptionnels justifiant l’exécution de la décision en France. Il tient compte notamment de l’intérêt de sa décision pour la bonne administration de la justice, de l’existence de liens personnels et familiaux en France et de l’absence de risque de trouble à l’ordre public.

Le procureur de la République informe l’autorité compétente de l’Etat de condamnation de la décision de consentir ou non à la transmission de la demande de reconnaissance de la condamnation ou de la décision de probation.
