Article 764-9 of the French Code of Criminal Procedure

The public prosecutor at the court that has handed down a conviction or made a probation decision involving alternative sanctions or measures provided for in Articles 764-3 and 764-4 shall be competent to forward the conviction or probation decision to the competent authority of another Member State of the European Union so that it may recognise and monitor the conviction or probation decision and, once it has been drawn up and signed, the certificate provided for in Article 764-6.

It may carry out this transfer on its own initiative or at the request of the competent authority of the executing State or of the person concerned.

Le ministère public près la juridiction ayant prononcé une condamnation ou rendu une décision de probation comportant des peines de substitution ou des mesures prévues aux articles 764-3 et 764-4 est compétent pour transmettre à l’autorité compétente d’un autre Etat membre de l’Union européenne, aux fins qu’elle reconnaisse cette condamnation ou cette décision de probation et en assure le suivi, la condamnation ou la décision de probation et, après l’avoir établi et signé, le certificat prévu à l’article 764-6.

Il peut procéder à cette transmission d’office ou à la demande de l’autorité compétente de l’Etat d’exécution ou de la personne concernée.
