Article 772 of the French Code of civil procedure

In the case provided for in Article 840, the copies of the application and of the exhibits delivered to the President shall, together with a copy of his order, be placed by the Registrar in the file, as soon as it is constituted.

If, on the day on which the case is to be called, the copy of the summons has not been delivered to the clerk’s office, the clerk shall, of his own motion, return to the lawyer the copies in his possession.

Dans le cas prévu à l’article 840, les copies de la requête et des pièces remises au président sont, ainsi qu’une copie de son ordonnance, placées par le greffier dans le dossier, dès sa constitution.


Si, le jour où l’affaire doit être appelée, la copie de l’assignation n’a pas été remise au greffe, le greffier restitue d’office à l’avocat les copies qu’il détient.
