Article 774-2 of the French Code of civil procedure

The purpose of the amicable settlement hearing is the amicable resolution of the dispute between the parties, through a balanced confrontation of their points of view, an assessment of their respective needs, positions and interests, and an understanding of the legal principles applicable to the dispute.

The judge in charge of the amicable settlement hearing may take cognisance of the submissions and exhibits exchanged by the parties.

He may make any observations, assessments, evaluations or reconstructions he deems necessary, visiting the premises if necessary.

He shall determine the conditions under which the hearing is held. He may decide to hear the parties separately.

L’audience de règlement amiable a pour finalité la résolution amiable du différend entre les parties, par la confrontation équilibrée de leurs points de vue, l’évaluation de leurs besoins, positions et intérêts respectifs, ainsi que la compréhension des principes juridiques applicables au litige.

Le juge chargé de l’audience de règlement amiable peut prendre connaissance des conclusions et des pièces échangées par les parties.

Il peut procéder aux constatations, évaluations, appréciations ou reconstitutions qu’il estime nécessaires, en se transportant si besoin sur les lieux.

Il détermine les conditions dans lesquelles l’audience se tient. Il peut décider d’entendre les parties séparément.
