Article 786 of the French Code of Criminal Procedure

An application for rehabilitation may only be made after a period of five years for those sentenced to a criminal penalty, three years for those sentenced to a correctional penalty and one year for those sentenced to a contraventional penalty.

This period runs, for those sentenced to a fine, from the day on which the sentence became irrevocable and, for those sentenced to a custodial penalty, from the day of their final release or, in accordance with the last paragraph of the article 733, from the day of their conditional release where this has not been followed by revocation.

In respect of those sentenced to a criminal penalty other than imprisonment or a fine, imposed as the principal penalty, this period runs from the expiry of the penalty served.

Article 786

La demande en réhabilitation ne peut être formée qu’après un délai de cinq ans pour les condamnés à une peine criminelle, de trois ans pour les condamnés à une peine correctionnelle et d’un an pour les condamnés à une peine contraventionnelle.

Ce délai part, pour les condamnés à une amende, du jour où la condamnation est devenue irrévocable et, pour les condamnés à une peine privative de liberté, du jour de leur libération définitive ou, conformément au dernier alinéa de l’article 733, du jour de leur libération conditionnelle lorsque celle-ci n’a pas été suivie de révocation.

A l’égard des condamnés à une sanction pénale autre que l’emprisonnement ou l’amende, prononcée à titre principal, ce délai part de l’expiration de la sanction subie.
