Article 831-2 of the French Cinema and Moving Image Code

In order to invest the sums entered in the automatic account or to benefit from an advance, the operators of cinematographic entertainment establishments must justify for each establishment:
1° Particular financial difficulties, in particular with regard to the size of their liabilities and their short-term cash flow situation;
2° A doubling of the amount of the bill relating to energy consumption compared to that corresponding to the same consumption period of the previous year. If the amount corresponding to the same period of consumption in the previous year was calculated on the basis of a tariff lower than the “blue” tariff provided for in article R. 337-18 of the Energy Code, the doubling is assessed on the basis of an amount recalculated on the basis of this tariff.

Pour investir les sommes inscrites sur le compte automatique ou pour bénéficier d’une avance, les exploitants d’établissements de spectacles cinématographiques justifient au titre de chaque établissement :
1° De difficultés financières particulières, notamment au regard de l’importance de leur passif et de la situation de leur trésorerie à court terme ;
2° Du doublement du montant de la facture relative à la consommation d’énergie par rapport à celui correspondant à la même période de consommation de l’année précédente. Dans le cas où le montant correspondant à la même période de consommation de l’année précédente a été calculé sur la base d’un tarif inférieur au tarif dit ” bleu ” prévu à l’article R. 337-18 du code de l’énergie, le doublement s’apprécie au regard d’un montant recalculé sur la base de ce tarif.
