Article 849-17 of the French Code of civil procedure

The power of attorney for the purposes of compensation given to the plaintiff in the action by virtue of the interested party’s membership of the group shall constitute authority to carry out on behalf of the latter all procedural acts and steps with a view to obtaining compensation for the loss suffered by it and falling within the scope of the group action, in particular for the exercise of remedies.

The power of attorney shall entail the advance by the plaintiff in the action of all expenses and costs relating to the proceedings and representation of the interested parties during the course of any investigative measures and during the legal action seeking compensation.
The mandate shall entail the advance payment by the claimant of all expenses and costs relating to the proceedings and the representation of the interested parties during any investigative measures and during the legal proceedings to obtain compensation for the damage suffered.

The interested party may terminate the group action at any time.
The interested party may terminate the mandate at any time. He must inform the claimant of this by any means that allows receipt to be acknowledged and the claimant must inform the person declared liable without delay. Revocation of the mandate entails renunciation of membership of the group.

Le mandat aux fins d’indemnisation donné au demandeur à l’action par l’effet de l’adhésion de la personne intéressée au groupe vaut pouvoir d’accomplir au nom de celle-ci tous actes de procédure et diligences en vue d’obtenir la réparation du préjudice subi par elle et entrant dans le champ de l’action de groupe, notamment pour l’exercice des voies de recours.


Le mandat emporte avance par le demandeur à l’action de toutes les dépenses et frais liés à la procédure et représentation des personnes intéressées lors du déroulement d’éventuelles mesures d’instruction et lors de l’action en justice tendant à la réparation du préjudice subi.


La personne intéressée peut mettre un terme au mandat à tout moment. Elle doit en informer le demandeur à l’action par tout moyen permettant d’en accuser la réception et celle-ci en avise la personne déclarée responsable sans délai. La révocation du mandat emporte renonciation à l’adhésion au groupe.
