In New Caledonia, infringements of the first four classes of the police regulations governing public road passenger transport services, laid down by local regulations, are recorded in official reports drawn up concurrently by sworn officials of New Caledonia, the provinces and communes and public service delegatees.
These officials are commissioned by the competent administrative authority or by the public service delegatee. After being approved by the public prosecutor, they take an oath before the court of first instance.
These agents are authorised to record the identity and address of the offender only when they are checking the existence and validity of passenger tickets. If the offender refuses or is unable to prove his identity, the agent of the public service delegatee shall immediately report the matter to any police officer of the national police force or the national gendarmerie with territorial jurisdiction, who may then immediately order the offender to be produced. In the absence of such an order, the agent of the public service delegate may not detain the offender.
