Article 919-68 of the French Cinema and Moving Image Code

In order to benefit from the exceptional aid, at least 50% of the cinemas for which the grouping or the lead company of the cartel ensures the programming belong to establishments that are independent of this grouping or this company, according to the following criteria:
1° The establishment is not directly operated by the grouping or the lead company;
2° The person who operates the establishment is not a subsidiary, within the meaning of article L. 233-1 of the French Commercial Code, of the grouping or the lead company of the cartel or is not controlled by a subsidiary of the grouping or the lead company of the cartel; 3° The grouping or the lead company of the cartel is not a subsidiary of the grouping or the lead company of the cartel. 233-1 of the French Commercial Code, of the cartel group or lead firm or is not controlled by a subsidiary of the cartel group or lead firm;
3° The cartel group or lead firm is not a subsidiary within the meaning of Article L. 233-1 of the French Commercial Code, of the person operating the establishment;
4° The cartel group or lead firm and the person operating the establishment are not subsidiaries, within the meaning of Article L. 233-1 of the French Commercial Code, of the same company.

Pour le bénéfice de l’aide exceptionnelle, au moins 50 % des salles des établissements de spectacles cinématographiques dont le groupement ou l’entreprise pilote de l’entente assure la programmation appartiennent à des établissements indépendants de ce groupement ou de cette entreprise, selon les critères suivants :
1° L’établissement n’est pas directement exploité par le groupement ou l’entreprise pilote ;
2° La personne qui exploite l’établissement n’est pas une filiale, au sens de l’article L. 233-1 du code de commerce, du groupement ou de l’entreprise pilote de l’entente ou n’est pas contrôlée par une filiale du groupement ou de l’entreprise pilote de l’entente ;
3° Le groupement ou l’entreprise pilote de l’entente n’est pas une filiale, au sens de l’article L. 233-1 du code de commerce, de la personne qui exploite l’établissement ;
4° Le groupement ou l’entreprise pilote de l’entente et la personne qui exploite l’établissement ne sont pas filiales, au sens de l’article L. 233-1 du code de commerce, de la même société.
