Article A37-30 of the French Code of Criminal Procedure

The official report provided for in III of Article 529-6 shall consist of a sheet, bearing on its front, in the order set out in this article, the following information:

1° The number of the official report;

2° The following heading: “Official report of non-payment of toll. Pursuant to articles L. 130-4, R. 130-4, R. 130-8 and R. 419-1 and R. 419-2 of the Highway Code”;

3° Details of the operating company;

4° Identification of the sworn official who recorded the offence;

5° The registration number and category of the vehicle;

6° The date, time and place of the offence and the facts recorded (motorway or road structure, direction, toll plaza or devices enabling vehicles to be identified and the amount of the toll to be collected without recourse to a physical barrier, commune[s], département[s]) and details of the offending text (art. R. 419-1 or R. 419-2 of the Highway Code depending on the offence recorded);

7° The date on which the official report was drawn up;

8° The signature of the sworn official, if applicable in digitised form;

9° The amount of the toll due, or the sum due, under the departmental right of way provided for in article L. 321-11 of the Environment Code, specifying that in the absence of an entry permit the amount of toll due is the amount for the most expensive journey.

Le procès-verbal prévu par le III de l’article 529-6 est constitué par un feuillet, comportant sur son recto, dans l’ordre fixé par le présent article, les mentions ci-après :

1° Le numéro du procès-verbal ;

2° L’intitulé suivant : ” Procès-verbal de constatation de non-paiement du péage. En application des articles L. 130-4, R. 130-4, R. 130-8 et R. 419-1 et R. 419-2 du code de la route ” ;

3° Les coordonnées de la société exploitante ;

4° L’identification de l’agent assermenté ayant constaté la contravention ;

5° Le numéro d’immatriculation et la catégorie du véhicule ;

6° La date, l’heure, le lieu de la contravention et les faits constatés (autoroute ou ouvrage routier, sens, gare de péage ou dispositifs permettant l’identification des véhicules et la perception du montant du péage sans recours à une barrière physique, commune [s], département [s]) et la précision du texte d’incrimination (art. R. 419-1 ou R. 419-2 du code de la route selon l’infraction constatée) ;

7° La date d’établissement du procès-verbal ;

8° La signature de l’agent assermenté, le cas échéant sous une forme numérisée ;

9° Le montant du péage dû, ou de la somme due, au titre du droit départemental de passage prévu à l’article L. 321-11 du code de l’environnement, en précisant qu’en cas de défaut de titre d’entrée le montant du péage dû est le montant du trajet le plus cher.
