Article A421-13 of the French Insurance Code

The rates of the contribution to the guarantee fund provided for in I of Article L. 421-10-1 are set as follows:

1° The rate applicable to the difference between the premiums for the last ten financial years and the technical provisions for the last financial year, referred to in 1° of I of Article L. 421-10-1, is set at 5%;

2° The percentage, referred to in 2° of I of Article L. 421-10-1, is set at 1% of the total expenses for the last financial year of the “Guarantee fund operations resulting from the withdrawal of authorisation for construction insurance companies” section.

The proceeds of this contribution are allocated in full to the profit and loss account of the “Operations of the guarantee fund resulting from the withdrawal of authorisation from construction insurance undertakings” section, as well as dividends to be recovered on liquidations, compensation paid, technical provisions established, management or administrative expenses relating to the intervention of the guarantee fund in connection with the withdrawal of authorisation from an insurance undertaking covering, on the territory of the French Republic, risks covered by compulsory insurance pursuant to Article L. 242-1, and, where applicable, the proceeds of the extraordinary contribution referred to in II of Article L. 421-10-1. The share of financial income allocated is taken into account in this same section.

Article A421-13

Les taux de la contribution au fonds de garantie, prévue au I de l’article L. 421-10-1, sont fixés comme suit :

1° Le taux applicable à la différence entre les primes des dix derniers exercices et les provisions techniques du dernier exercice, mentionné au 1° du I de l’article L. 421-10-1, est fixé à 5 % ;

2° Le pourcentage, mentionné au 2° du I de l’article L. 421-10-1, est fixé à 1 % de la totalité des charges du dernier exercice de la section “ Opérations du fonds de garantie résultant du retrait d’agrément d’entreprises d’assurance construction ”.

Le produit de cette contribution est intégralement affecté au compte de résultat de la section “ Opérations du fonds de garantie résultant du retrait d’agrément d’entreprises d’assurance construction ”, ainsi que les dividendes à recouvrer sur les liquidations, les indemnités versées, les provisions techniques constituées, les frais de gestion ou d’administration afférents à l’intervention du fonds de garantie liée au retrait d’agrément d’une entreprise d’assurance couvrant sur le territoire de la République française les risques relevant de l’assurance obligatoire en vertu de l’article L. 242-1, et, le cas échéant, le produit de la contribution extraordinaire mentionnée au II de l’article L. 421-10-1. La quote-part des produits financiers alloués est prise en compte dans cette même section.
