Article A421-4-5 of the French Insurance Code

For the entire asset portfolio, the guarantee fund only invests in assets and instruments with risks that it can identify, measure, monitor, manage, control and report adequately.

All assets are invested in such a way as to guarantee both the security, quality, liquidity and profitability of the portfolio as a whole and the financial capacity of the guarantee fund to carry out its public service missions. In addition, the location of these assets must guarantee their availability.

In the event of a conflict of interest, the guarantee fund or the entities managing its asset portfolio must ensure that the investment is made in the best interests of its public service missions.

Pour l’ensemble du portefeuille d’actifs, le fonds de garantie n’investit que dans des actifs et instruments présentant des risques qu’il peut identifier, mesurer, suivre, gérer, contrôler et déclarer de manière adéquate.

Tous les actifs sont investis de façon à garantir aussi bien la sécurité, la qualité, la liquidité et la rentabilité de l’ensemble du portefeuille que les capacités financières du fonds de garantie à mener ses missions de service public. En outre, la localisation de ces actifs doit permettre de garantir leur disponibilité.

En cas de conflit d’intérêts, le fonds de garantie ou les entités qui gèrent son portefeuille d’actifs, veillent à ce que l’investissement soit réalisé au mieux des intérêts de ses missions de service public.
