Article A421-9 of the French Insurance Code

All income and expenses relating to the intervention of the guarantee fund, in the event of the withdrawal of authorisation of an insurance undertaking covering, on the territory of the French Republic, risks covered by compulsory insurance pursuant to Article L. 242-1, are recorded in a specific section of its accounts entitled “Operations of the guarantee fund resulting from the withdrawal of authorisation from construction insurance companies”.

For this accounting monitoring, the following is established:

1° A section in the income statement;

2° A specific asset and liability account in the balance sheet;

3° An appendix containing a summary statement of operations carried out during the financial year, the share of financial income, receivables, technical provisions and other liabilities.

La totalité des recettes et des charges afférentes à l’intervention du fonds de garantie, en cas de retrait d’agrément d’une entreprise d’assurance couvrant sur le territoire de la République française les risques relevant de l’assurance obligatoire en vertu de l’article L. 242-1, sont retracées dans une section spécifique de ses comptes intitulée “ Opérations du fonds de garantie résultant du retrait d’agrément d’entreprises d’assurance construction ”.


Pour ce suivi comptable, il est établi :


1° Une section dans le compte de résultat ;


2° Un compte d’actif et de passif spécifique au bilan ;


3° Une annexe comportant un état récapitulatif des opérations menées dans l’exercice, de la quote-part des produits financiers, des créances, des provisions techniques, et des autres dettes.
