Article A444-3 of the French Commercial code

The judicial sale by public auction of tangible or intangible movable property, listed in number 4 of the table mentioned in article A. 444-1, gives rise to the collection of a fee proportional to the proceeds of each lot, according to the following scale:

Applicable rate

a) Share payable by the vendor 4.96%
b) Share payable by the buyer 11.90%
Total 16.86%

If the total chargeable to the sellers is, for the entire sale, less than 45.63 euros, the emolument is increased to this sum, and divided between the sellers.

The emolument mentioned in the first paragraph does not apply to the sale of the item pledged as part of a loan granted by a municipal credit union under the conditions provided for in article D. 514-17 of the Monetary and Financial Code, which is remunerated in accordance with the terms set out in the first and third paragraphs of article D. 514-18 of the same code.

La vente judiciaire aux enchères publiques de meubles corporels ou incorporels, figurant au numéro 4 du tableau mentionné à l’article A. 444-1, donne lieu à la perception d’un émolument proportionnel au produit de chaque lot, selon le barème suivant :

a) Part à la charge du vendeur

4,96 %

b) Part à la charge de l’acheteur

11,90 %

Total

16,86 %

Si le total à la charge des vendeurs est, pour l’ensemble de la vente, inférieur à 45,63 euros, l’émolument est porté à cette somme, et réparti entre les vendeurs.

L’émolument mentionné au premier alinéa ne s’applique pas à la vente de l’objet gagé dans le cadre d’un prêt consenti par une caisse de crédit municipal dans les conditions prévues à l’article D. 514-17 du code monétaire et financier, qui est rémunérée selon les modalités prévues aux premier et troisième alinéas de l’article D. 514-18 du même code.
