Article A53-2 of the French Code of Criminal Procedure

An advanced electronic signature based on a qualified certificate within the meaning of Article D. 589-3 is an advanced electronic signature, in accordance with Article 26 of Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/ EC, which is based on a qualified electronic signature certificate meeting the requirements of Article 28 of that Regulation.

The technical device enabling this electronic signature to be affixed is subject to security approval in accordance with Article 5 of Decree no. 2010-112 of 2 February 2010 taken for the application of Articles 9, 10 and 12 of ordonnance no. 2005-1516 of 8 December 2005 relating to electronic exchanges between users and administrative authorities and between administrative authorities.

Est une signature électronique avancée reposant sur un certificat qualifié au sens de l’article D. 589-3 une signature électronique avancée, conforme à l’article 26 du règlement (UE) n° 910/2014 du Parlement européen et du Conseil du 23 juillet 2014 sur l’identification électronique et les services de confiance pour les transactions électroniques au sein du marché intérieur et abrogeant la directive 1999/93/ CE, qui repose sur un certificat qualifié de signature électronique répondant aux exigences de l’article 28 de ce règlement.


Le dispositif technique permettant d’apposer cette signature électronique fait l’objet d’une homologation de sécurité conformément à l’article 5 du décret n° 2010-112 du 2 février 2010 pris pour l’application des articles 9,10 et 12 de l’ordonnance n° 2005-1516 du 8 décembre 2005 relative aux échanges électroniques entre les usagers et les autorités administratives et entre les autorités administratives.
