Article A752-2 of the French Commercial code

I.-The application form for authorisation referred to in Article R. 752-44-3, a model of which is appended to the Order of 28 June 2019 setting the content of the application form for authorisation to draw up the certificate of conformity referred to in the first paragraph of Article L. 752-23 of the French Commercial Code , bears the letterhead of the prefecture in whose jurisdiction the authorisation is requested.

II.-The form comprises three sections, to be completed by the applicant for authorisation:

1° The identity and full postal, telephone and electronic contact details of the applicant organisation;

2° The surnames, first names, dates and places of birth, diplomas or qualifications of all the persons called upon to carry out the certification tasks on behalf of the organisation;

3° The date of the application for authorisation, followed by the signature of the legal representative of the applicant organisation.

III.-The form states:

1° The list of documents referred to in Article R. 752-44-2, to be attached to the application for authorisation: for each natural person by whom or under whose responsibility the certificates of conformity will be drawn up, an extract from the criminal record less than three months old, proof of the qualification or diploma referred to in 3° of Article R. 752-44-2, and a copy of the identity document; for the body, the unique identification number, proof of the inspection resources and tools referred to in 2° of Article R. 752-44-2 and an up-to-date certificate of professional insurance;

2° The procedures for submitting the application for authorisation and the deadlines for processing the application referred to in Articles R. 752-44-3 and R. 752-44-4.

I.-Le formulaire de demande d’habilitation mentionné à l’article R. 752-44-3, dont un modèle est annexé à l’arrêté du 28 juin 2019 fixant le contenu du formulaire de demande d’habilitation pour établir le certificat de conformité mentionné au premier alinéa de l’article L. 752-23 du code de commerce , porte l’en-tête de la préfecture dans le ressort de laquelle l’habilitation est demandée.

II.-Le formulaire comporte trois rubriques, à renseigner par le demandeur de l’habilitation :

1° L’identité et les coordonnées postales, téléphoniques et électroniques complètes de l’organisme demandeur ;

2° Les noms, prénoms, dates et lieux de naissance, diplômes ou titres de toutes les personnes appelées à réaliser les missions de certification au nom de l’organisme ;

3° La date de la demande d’habilitation, suivie de la signature du représentant légal de l’organisme demandeur.

III.-Le formulaire rappelle :

1° La liste des pièces mentionnées à l’article R. 752-44-2, à joindre à la demande d’habilitation : pour chaque personne physique par laquelle ou sous la responsabilité de laquelle seront établis les certificats de conformité, un extrait du casier judiciaire datant de moins de trois mois, un justificatif du titre ou diplôme mentionné au 3° de l’article R. 752-44-2, et une copie de la pièce d’identité ; pour l’organisme, le numéro unique d’identification, un justificatif des moyens et outils de contrôle mentionnés au 2° de l’article R. 752-44-2 et une attestation d’assurance professionnelle à jour ;

2° Les modalités de dépôt de la demande d’habilitation et les délais d’instruction de la demande mentionnés aux articles R. 752-44-3 et R. 752-44-4.
