“In order for a legal entity to be registered on the list of sworn goods brokers of a court of appeal, it must be justified :

1° That its directors have not been the subject of a final criminal conviction for acts contrary to honour, probity or good morals or acts of the same nature that have given rise to a disciplinary or administrative sanction of dismissal, striking off, revocation, withdrawal of approval or authorisation in the profession they previously exercised ;

2° That the legal entity has been engaged in the business of commodities brokerage for at least two years in the professional speciality for which registration is sought;

3° That the activities in which the legal entity engages are not incompatible with the duties of a sworn commodities broker ;

4° That its directors, partners or employees include at least one person who meets the conditions set out in 1°, 2°, 4° (as from 1 January 2015) and 5° of Article L. 131-13 of the Commercial Code;

5° That it has its registered office, a branch or an establishment related to its speciality within the jurisdiction of the Court of Appeal. “

Certify on my honour that I have not been the perpetrator of any acts that have given rise to a disciplinary or administrative sanction of dismissal, striking off, revocation, withdrawal of approval or authorisation in the profession that I previously practised, where applicable.

Déclare prendre connaissance des dispositions de l’article L. 131-14 du code de commerce aux termes desquelles :

” En vue de l’inscription d’une personne morale sur la liste des courtiers de marchandises assermentés d’une cour d’appel, il doit être justifié :

1° Que ses dirigeants n’ont pas fait l’objet d’une condamnation pénale définitive pour des faits contraires à l’honneur, à la probité ou aux bonnes mœurs ou de faits de même nature ayant donné lieu à une sanction disciplinaire ou administrative de destitution, radiation, révocation, de retrait d’agrément ou d’autorisation dans la profession qu’ils exerçaient antérieurement ;

2° Que la personne morale exerce une activité de courtage de marchandises depuis au moins deux ans dans la spécialité professionnelle pour laquelle l’inscription est demandée ;

3° Que les activités auxquelles se livre la personne morale ne sont pas incompatibles avec les fonctions de courtier de marchandises assermenté ;

4° Qu’elle compte parmi ses dirigeants, associés ou salariés au moins une personne remplissant les conditions prévues aux 1°, 2°, 4° (à compter du 1er janvier 2015) et 5° de l’article L. 131-13 du code de commerce ;

5° Qu’elle a son siège social, une succursale ou un établissement en rapport avec sa spécialité dans le ressort de la cour d’appel. ”

Certifie sur l’honneur n’avoir pas été l’auteur de faits ayant donné lieu à une sanction disciplinaire ou administrative de destitution, radiation, révocation, de retrait d’agrément ou d’autorisation dans la profession que j’exerçais, le cas échéant, antérieurement.
