Article D1225-8-1 of the French Labour Code

In addition to the leave referred to in article L. 1225-35, the father, the mother’s spouse or the person bound to her by a civil solidarity pact or the cohabiting partner is entitled to an extension of the period of leave referred to in the fifth paragraph of this article in the event of the child’s immediate hospitalisation after birth, for the entire period of hospitalisation in one or more specialised care units mentioned in the order referred to in the same paragraph, up to a maximum of thirty consecutive days.

The employee benefiting from this leave shall inform his/her employer without delay, providing documentary evidence of the hospitalisation.

En sus du congé mentionné à l’article L. 1225-35, le père, le conjoint de la mère ou la personne liée à elle par un pacte civil de solidarité ou son concubin a droit à la prolongation de la période de congé mentionnée au cinquième alinéa de cet article en cas d’hospitalisation immédiate de l’enfant après la naissance, pendant toute la période d’hospitalisation dans une ou plusieurs unités de soins spécialisés mentionnées dans l’arrêté prévu au même alinéa, et dans la limite de trente jours consécutifs.

Le salarié bénéficiant de ce congé en informe son employeur sans délai en transmettant un document justifiant de cette hospitalisation.
