Article D1235-18 of the French Labour Code

When a trade union organisation intends to take legal action on behalf of an employee, in application of Article L. 1235-8, it notifies the employee by registered letter with acknowledgement of receipt.
If the employee has not objected, the trade union organisation shall notify the employer in the same way of its intention to take legal action.

Lorsqu’une organisation syndicale a l’intention d’exercer une action en justice en faveur d’un salarié, en application de l’article L. 1235-8, elle l’en avertit par lettre recommandée avec avis de réception.
Si le salarié ne s’y est pas opposé, l’organisation syndicale avertit l’employeur dans les mêmes formes de son intention d’agir en justice.
