Article D142-3 of the French Code of Criminal Procedure

A prisoner who is granted a temporary absence must bear the costs incurred by his stay outside the establishment, in particular the cost of any transport he may be obliged to use.

Consequently, no temporary absence may be granted if the prisoner does not have a sufficient sum available or if the prisoner does not have legal accommodation and transport options.

Le détenu bénéficiaire d’une permission de sortir doit supporter les frais occasionnés par son séjour hors de l’établissement et notamment le coût des moyens de transport qu’il serait éventuellement obligé d’utiliser.


En conséquence, aucune permission de sortir ne peut être accordée si une somme suffisante ne figure pas à la part disponible du condamné ou si l’intéressé ne justifie pas de possibilités licites d’hébergement et de transport.
