Article D1442-10-3 of the French Labour Code

The authorisations for absence mentioned in 1° of article L. 1442-2 are granted to employees at their request as soon as they are appointed and until the end of the fifteen-month period mentioned in the second paragraph of article D. 1442-10-1.

The Conseiller prud’homme shall inform his employer of his absence for the training provided for in 1° of article L. 1442-2 by any means giving a date certain:

1° At least thirty days in advance, if the period of absence is equal to or greater than three consecutive working days ;

2° At least fifteen days in advance in other cases.

This information shall specify the date, duration and times of the course and the name of the organisation responsible.

Les autorisations d’absence mentionnées au 1° de l’article L. 1442-2 sont accordées aux salariés à leur demande dès leur nomination et jusqu’au terme de la période de quinze mois mentionnée au deuxième alinéa de l’article D. 1442-10-1.

Le conseiller prud’homme informe son employeur de son absence pour la formation prévue au 1° de l’article L. 1442-2 par tout moyen conférant date certaine :

1° Au moins trente jours à l’avance, en cas de durée d’absence égale ou supérieure à trois journées de travail consécutives ;

2° Au moins quinze jours à l’avance dans les autres cas.

Cette information précise la date, la durée et les horaires du stage ainsi que le nom de l’organisme responsable.
