Article D1442-12 of the French Public Health Code

For the application to Guadeloupe, Saint-Barthélemy and Saint-Martin of article D. 1432-15, 1° to 3° of I are worded as follows:

1° Three representatives of the State:

a) The rector of the Guadeloupe education authority or his representative;

b) The head of the regional State department responsible for social cohesion or his representative;

c) The State representative in Saint-Barthélemy and Saint-Martin or the delegated prefect responsible for matters relating to the collectivities of Saint-Barthélemy and Saint-Martin or their representative;

2° Nine members of the boards and councils of the local health insurance bodies within its remit:

a) Five members of the board of directors of the general social security fund of Guadeloupe appointed by representative employee trade unions at national and cross-industry level;

b) Three members of the board of directors of the general social security fund of Guadeloupe appointed by representative employers’ professional organisations at national and cross-industry level;

c) The president of the basic fund of the social security scheme for the self-employed or his representative.

3° Five representatives of local and regional authorities, including:

a) A regional councillor from Guadeloupe appointed by the regional council;

b) A general councillor from Guadeloupe appointed by the general council;

c) A territorial councillor from Saint-Barthélemy appointed by the territorial council;

d) A territorial councillor from Saint-Martin appointed by the territorial council;

e) A mayor of a municipality or the president of a group of municipalities appointed by the Association of French Mayors.

Pour l’application à la Guadeloupe, à Saint-Barthélemy et à Saint-Martin de l’article D. 1432-15, les 1° à 3° du I sont ainsi rédigés :

1° Trois représentants de l’Etat :

a) Le recteur de l’académie de Guadeloupe ou son représentant ;

b) Le chef du service régional de l’Etat chargé de la cohésion sociale ou son représentant ;

c) Le représentant de l’Etat à Saint-Barthélemy et à Saint-Martin ou le préfet délégué chargé des questions relatives aux collectivités de Saint-Barthélemy et Saint-Martin ou leur représentant ;

2° Neuf membres des conseils et conseils d’administration des organismes locaux d’assurance maladie de son ressort :

a) Cinq membres du conseil d’administration de la caisse générale de sécurité sociale de Guadeloupe désignés par des organisations syndicales de salariés représentatives au niveau national et interprofessionnel ;

b) Trois membres du conseil d’administration de la caisse générale de sécurité sociale de Guadeloupe désignés par les organisations professionnelles d’employeurs représentatives au niveau national et interprofessionnel ;

c) Le président de la caisse de base du régime social des indépendants ou son représentant.

3° Cinq représentants des collectivités territoriales dont :

a) Un conseiller régional de Guadeloupe désigné par le conseil régional ;

b) Un conseiller général de Guadeloupe désigné par le conseil général ;

c) Un conseiller territorial de Saint-Barthélemy désigné par le conseil territorial ;

d) Un conseiller territorial de Saint-Martin désigné par le conseil territorial ;

e) Un maire d’une commune ou le président d’un groupement de communes désigné par l’association des maires de France.
