Article D1442-14 of the French Labour Code

On the day of the public installation of the industrial tribunal, on the occasion of the formal hearing mentioned in 1° of article R. 1423-13, the minutes of the taking of the oath are read out. The councillors mentioned in 1° of article D. 1442-11 take up their duties upon installation.

The councillors mentioned in 2° of article D. 1442-11 are installed at the hearing of the adjudication committee of the section concerned, which follows the publication of the appointment order referred to in article L. 1441-26 or the taking of the oath.

Within eight days of the installation of an employee as a labour court councillor, the director of the court registry will send his employer a letter informing him of the date on which the councillor will take up his duties.

Article D1442-14

Le jour de l’installation publique du conseil de prud’hommes, à l’occasion de l’audience solennelle mentionnée au 1° de l’article R. 1423-13, une lecture du procès-verbal de réception du serment est faite. L’installation vaut entrée en fonctions des conseillers mentionnés au 1° de l’article D. 1442-11.

L’installation des conseillers mentionnés au 2° de l’article D. 1442-11 a lieu lors de l’audience du bureau de jugement de la section concernée qui suit la publication de l’arrêté de nomination visé à l’article L. 1441-26 ou la réception du serment.

Dans les huit jours de l’installation d’un salarié comme conseiller prud’homme, le directeur de greffe adresse à son employeur un courrier l’informant de la date d’entrée en fonctions de ce conseiller.
